By accessing or using the Friendly Accessibility website, services, training, or materials, you agree to these Terms of Use. If you do not agree, please do not use our services.

 

2. User Eligibility

To use our website and services, you must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess the legal authority to enter into these Terms as a binding agreement. Use of this website is prohibited if doing so violates any law or regulation applicable to you.

 

3. Services Overview

​

Friendly Accessibility provides digital accessibility training, sensory awareness training, educational resources, and other professional services. All services and materials are provided for educational purposes only.

4. Educational Purpose & Legal Disclaimer

All training, resources, tools, and information provided by Friendly Accessibility and/or Julie Steele are educational guidance only and do not constitute legal advice. Training and resources are not determinations of your legal rights, responsibilities, or compliance status, nor are they binding on any agency with legal enforcement responsibility. For legal advice specific to your situation, please consult a qualified attorney.

 

5. No Compliance Guarantees

While our training aims to help organizations improve accessibility practices, we make no guarantees regarding compliance with any laws, regulations, or standards including the Americans with Disabilities Act (ADA), Section 508, WCAG, or any other accessibility requirements.

 

6. Intellectual Property & Ownership

​

All content, materials, training resources, trademarks, logos, and intellectual property provided by Friendly Accessibility remain our exclusive property. Users may not reproduce, distribute, modify, sell, license, rent, copy, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works without express written permission.

Third-Party Property: Safari, iPhone, Acrobat, Word, PowerPoint, Chrome, WAVE tools, emojis, and WCAG materials are owned by Apple, Adobe, Microsoft, Google, Utah State University, Unicode.org, Zoom, and the W3C respectively.

 

User-Uploaded Content: By uploading any content to our website, you confirm you own all relevant rights or have received appropriate licenses. You agree and consent that uploaded content may be publicly displayed on the website.

 

7. AI Usage Restrictions

With the exception of our AI prompt templates, you may not share, upload, or input our content into AI systems, including chatbots, large language models (LLMs), machine learning tools, or automated scanners.

 

8. Payment Terms

​

  • Free training is available for public schools, libraries, hospitals, and public safety organizations

  • Fee-based services require payment according to agreed terms

  • All payments are processed through trusted third-party payment providers (such as PayPal, Intuit, Apple Pay, Google Pay, ThriveCart, Wix, Stripe, etc.)

  • Business invoicing is available upon request

  • Prices are subject to change; we reserve the right to modify pricing and correct pricing errors

 

9. Third-Party Services

Our services may incorporate or reference third-party tools, platforms, or providers. Some educational content may be deployed through third-party providers such as Google, Apple, Zoom, Wix, Adobe, Microsoft, etc. We are not responsible for third-party content, services, or policies. All third-party providers have their own Terms of Use, Privacy Policies, and Accessibility Statements. Users should review the separate terms and policies of any third-party providers.

 

10. Right to Modify Services

We may, without prior notice, change services; stop providing services or any features; or create limits for services. We may permanently or temporarily terminate or suspend access to services without notice and liability for any reason, including if you violate any provision of these Terms or applicable law.

 

11. Account Suspension or Cancellation

​

We may permanently or temporarily terminate or suspend your access without notice and liability for any reason. You may discontinue use and request account cancellation at any time. For automatically-renewed subscriptions to paid services, cancellations take effect upon expiration of the period for which payment was already made.

 

12. Limitation of Liability

​

To the fullest extent permitted by applicable law, Friendly Accessibility and/or Julie Steele shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages (including damages for loss of profits, goodwill, use, data, or other intangible losses) arising from your use of our services or materials.

To the maximum extent permitted by applicable law, Friendly Accessibility and/or Julie Steele assumes no liability for: (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage resulting from your access to or use of our services; and (iii) any unauthorized access to or use of our servers and/or any personal information stored therein.

 

13. Indemnification

You agree to indemnify and hold Friendly Accessibility and/or Julie Steele harmless from any demands, loss, liability, claims, or expenses (including attorneys' fees) made by any third party due to, arising out of, or in connection with your use of the website or services.

 

14. Warranties

We warrant that our website content will be available as intended and will work to fix problems that may arise.

 

15. Promotional Communications

​

You may receive promotional messages and materials from us by mail, email, or other contact methods. You may opt out of receiving promotional materials at any time by notifying us.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. If we make material changes, we will notify you by updating this page. Your continued use of our services after changes constitutes acceptance of the modified Terms. If you do not agree to modified Terms, discontinue use immediately.

 

17. Governing Law & Dispute Resolution

These Terms, and any claims or disputes related to our services, shall be governed exclusively by the laws of the State of California and the United States, without regard to conflict of law principles. Any disputes shall be decided exclusively by a court of competent jurisdiction located in Palo Alto, California. You consent to the jurisdiction of such courts. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

 

18. User Communities

Our sites do not include public or private user communities.
